Welcome to Bristol Heights Neighborhood Association ("BHNA").   These Terms of Use ("Terms") govern your access to and use of our website located at bristolheights.org (the "Site") and any related services (collectively, the "Services"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use this Site.

1. ACCEPTANCE OF TERMS
By using this Site, you affirm that you are at least 18 years of age or are an emancipated minor, and are fully able and competent to enter into these Terms.

2. INTELLECTUAL PROPERTY
All content on this Site, including but not limited to text, graphics, logos, images, software, and the compilation thereof, is the property of BHNA or its suppliers and is protected by copyright and intellectual property laws. You may not use, reproduce, or distribute any content without our express written permission.

3. USER CONDUCT AND RESTRICTIONS
You agree to use the Site only for lawful purposes. You are prohibited from: Modifying, hacking, or attempting to compromise the security of the Site. Using the Site to send unsolicited commercial email (SPAM).  Scraping, crawling, or using any automated means to extract data.Transmitting any obscene, racist, or threatening material.

4. USER ACCOUNTS
If you create an account, you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. We reserve the right to terminate accounts at our sole discretion for violations of these terms.

5. USER-GENERATED CONTENT
If you post or upload content to the Site, you grant us a non-exclusive, royalty-free, perpetual license to use, reproduce, and distribute that content.

6. THIRD-PARTY LINKS
Our Site may contain links to third-party websites. We do not control or endorse these websites and are not responsible for their content or policies.

7. LIMITATION OF LIABILITY
BHNA will not be liable for any damages arising out of your use of the Site, including but not limited to direct, indirect, incidental, or punitive damages. The Site is provided on an "as is" and "as available" basis without any warranties.

You agree to indemnify and hold harmless BHNA and its directors, officers, contractors and agents from any claims, damages, or expenses (including attorney fees) resulting from your violation of these Terms or misuse of the Site.

9. GOVERNING LAW AND VENUE
These Terms are governed by the laws of the State of Idaho, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Ada County, Idaho.

10. NOT A PUBLIC ACCOMMODATION
The Site is neither a public accommodation nor a place of public accommodation under 42 U.S.C. § 12181(7).  The Site is intended for use by a private membership of owners of properties in the Bristol Heights subdivision and their tenants and guests.

11. CHANGES TO TERMS
We reserve the right to update these Terms at any time. Your continued use of the Site after changes are posted constitutes your acceptance of the new Terms.
